Duty of care Inside the door sat a pile of unopened mail on the floor in 2011. When I asked Mum to open it together we found cheques in her name which had been there since 2007. These were small shareholders payment from Mum's small investments in Centrica and others. All of them, those Davis scum just left them there . Emergency Protection Order (EPO)
If the court thinks it would be dangerous for your child to live at home, or thinks someone else should leave your home, then it can make an EPO. This sort of order usually lasts for 8 days and will never last more than 15 days. Your child might have to leave home for a short while (but never longer than 15 days, unless the court decides that a Care Order is necessary). If your child does have to leave home, family and friends can still visit them if your child wants this.
Care Orders
The court might make a Care Order if it thinks it is not safe for your child to live at home. It will give the Local Authority the same responsibilities as a parent and decisions can be taken as to where the child may live.
Supervision Orders
This order means that your child can still stay at home, but a social worker would be in regular contact with you and your child. There may be directions attached to the order that ask you to do something specific, for example, make sure your child attends a Family Centre or keeps medical appointments.
Section 8 Orders
A contact order - an order that says that a person that the child lives with, or is to live with, must allow the child to visit or stay with the person named in the order, or for that person and the child to have indirect contact with each other, or prohibiting contact with the person named in the order
A prohibited steps order - an order that says no step may be taken by a parent in meeting their parental responsibility for a child, which is of a kind specified in the order, shall be taken by any person without the consent of the court
A residence order - an order setting the arrangements to be made regarding the person a child lives with
A specific issue order - an order giving directions regarding a specific question which has arisen, or which may arise, in connection with any aspect of parental responsibility for a child
Police Protection
The police can take your child into police protection if they think that your child is in immediate danger. This will usually last for up to 72 hours and they must inform you and a Social Worker of the whereabouts of your child or children.
Criminal Cases
If your child has been seriously abused then the person or people who abused them may be charged.
Child Assessment Orders
A Child Assessment Order may be made as part of a child protection investigation. It means the court thinks that there may be medical evidence that your child may have hurt or abused. Medical evidence means facts that show that your child has been hurt on purpose or in ways that wouldn't usually happen to them.
Under this type of order your child does not have to leave home if they do not wish to, however, if they do leave home it will usually be

Section 2A offence - Stalking
The elements of the section 2A offence are:
a course of conduct which is in breach of section 1(1) of the Protection from Harassment Act 1997 (i.e. a course of conduct which amounts to harassment) and
the course of conduct amounts to stalking.
This means that there has to be a course of conduct which amounts to harassment and that particular harassment can be described as stalking behaviour.
A course of conduct is the same as defined under section 7 of the PHA 1997 and referred to elsewhere in this guidance.
Definition of stalking
Stalking is not legally defined but section 2A (3) of the PHA 1997 lists a number of examples of behaviours associated with stalking. The list is not an exhaustive one but gives an indication of the types of behaviour that may be displayed in a stalking offence. The listed behaviours are:
(a) following a person,
(b) contacting, or attempting to contact, a person by any means,
(c) publishing any statement or other material relating or purporting to relate to a person, or purporting to originate from a person,
(d) monitoring the use by a person of the internet, email or any other form of electronic communication,
(e) loitering in any place (whether public or private),
(f) interfering with any property in the possession of a person,
(g) watching or spying on a person.
Section 2A is a summary offence and a person guilty of the offence of stalking is liable on summary conviction to imprisonment for a term not exceeding 6 months or a fine.
As a summary only offence, the section 2A offence requires an information or complaint to be laid within 6 months from the time when the offence was committed, or the matter of complaint arose. The 6 months' limitation should run from the last date of the course of conduct alleged.
An integral part of the stalking offence is establishing that harassment has taken place. In determining whether the defendant ought to know that the course of conduct amounts to harassment, the question to be considered is whether a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.
Defence - Stalking - section 2A
If the suspect is able to show that any of the defences to harassment under section 1(3) of the PHA are made out, he or she can not be guilty of stalking as without harassment there can be no conviction for stalking.
S.4 offence - Putting People in Fear of Violence
The elements of the section 4 offence are:
a course of conduct;
which causes another to fear that violence will be used against him; and
which the defendant knows or ought to know will cause another to fear that violence will be used against him; and
the defendant ought to know that his course of conduct will cause another to fear that violence will be used against them if a reasonable person in possession of the same information would think that the course of conduct would cause the other so to fear on that occasion.

Section 4 also includes the following statutory defences. It is for the defendant to show that:
the course of conduct was pursued for the purpose of preventing or detecting crime;
the course of conduct was pursued under any enactment or rule of law or to comply with any condition or requirement imposed by any person under any enactment; or
pursuit of the course of conduct was reasonable for the protection of him or herself or another or for the protection of her, his or another's property.

Affects of violent threats on a nine year old child My daughter Mary is street wide and resilient. She attends St Botolph's C of E School and is proitected and nurtured there by Mrs Daniels and staff Despite her apparent maturity she has been severly traumatised by seeing at very close quarter her Father threatened with violence by a person she regards as an Uncle, Mr John Henry Davis of 20 Mayfield Road Peterborough. On the very day follwoing this incident Maary accompanied by me returned to Peterborough towjn centre, Nary was acutely aware of noise and the proximity of people. Whe, to take lunch, we approach a poublic house inNorth Steet Peterborough, Mary fesfused to enter saying that the presence of people and the noise upset her, she felt insecure and threatened. I acceeded to her wishes of course. Mary and I both consulted our Doctor following this traumatic incident and I am fearful of her present mood and behaviour. I have advised the school who will keep a careful watch over her Mary received a certificate in 2013 for her helpful and humane approach and her willingness to help other children. On Monday 7th Jan 2012 the Peterborough Police will be petitioned and presented with a document relating to threats of violence (in a PUB, the Carpenters Arms in Cowagate Peterborough) directed towards me, Peter Francis ,when I was accompanied by Mary Francis my 9 year old daughter. There were many witnesses.
A crass and base act from someone with animalistic tendencies, to put it mildly, and a history of threats and menaces again me

Peter, seeks to console, comfort and reassure her by telling her that Uncle John Henry Davis is angry with himself and throwing his toys out of his pram because he (me, her Dad) has written something that annoys Uncle John and Uncle John wants to kick your Dad with his great big army boots, - but Uncle John Henry may not hurt her. Officer Walsh is nice and advises me to go quietly now about my own business. He says he will look for you and advise you how you should comport yersel' . Naturally, I am bothered. but for Mary's sake and not to waste the day, I follow his advice.
This afternnon I visit Dr Outar at my Orton NHS surgery to check for any arrow heads stuck in me or other wounds - and because you have disturbed my day and my BP and exacerbated my anxieties and arthritus. Dr Outar advises me what to do to protect my health and MNary's too
And tomorrow I shall complete this circle and this log at the Peterborough Police Station with a formal complaint my brother. Yes I shall JHD, the 'Old Bill' will receive me well I am sure.
